BBB National Programs’ National Advertising Division decided a challenge Kenvue Inc. brought against Hims & Hers Health over advertising for its hair regrowth products. NAD found that Hims & Hers has a reasonable basis for its central claim that combining finasteride and minoxidil works better than either ingredient alone, but recommended the company discontinue or modify separate claims describing its products as doctor trusted and dermatologist recommended, along with related safety and side effect disclosures. The decision, published August 24, offers a fresh data point on how NAD evaluates survey based substantiation for expert endorsement claims. No qualifying DSHEA legislative action or FDA and FTC supplement enforcement activity surfaced within the last 24 hours.

BBB National Programs’ National Advertising Division determined that Hims & Hers Health has a reasonable basis for its claim that a combination product containing finasteride and minoxidil, marketed as Hims Hair Hybrids, works better than either ingredient alone. The decision came in response to a challenge from Kenvue Inc., which also contested claims that Hims & Hers products are doctor trusted and dermatologist recommended. NAD recommended that Hims & Hers discontinue the dermatologist recommended claim, finding the company’s dermatologist trust survey was not a good fit to substantiate it, and recommended modification or discontinuance of related claims about safety and side effects. Hims & Hers can appeal the decision to the National Advertising Review Board. The case is the latest in a series of NAD challenges testing how far survey based evidence can stretch to support expert endorsement and safety claims in health and wellness advertising.
